Daniel Kerr, a 51-year-old Palm Bay man found guilty last week by a jury on a charge of lewd and lascivious molestation, was granted a judgment of acquittal by Senior Judge Lawrence Johnston this morning.

Kerr was arrested and charged for allegedly having sexual contact with a child younger than the age of 12.

Defense Attorney Jonathan Bull had asked for an acquittal because the victim, who is now 10, recanted her statement before the jury and said she lied previously.

The decision surprised Bull, who said he had never had a similar decision in his legal career. Judge Johnston read from a written ruling and said his decision was based, in part, because the victim recanted in front of the jury.

“Making decisions and unpopular decisions are part of my duties,” Johnston said as he hurried out of the courtroom even as Assistant State Attorney Julia Lynch said she wanted to address the court.

“This is a jury verdict,” said Lynch, who was visibly upset after the judge’s ruling. “They heard all the evidence.” Lynch said the state would be asking for a rehearing on the issue.

Kerr could have been sentenced to anything between six-and-a-half years to life in prison.

In its winning bid for the project, SISCO has also provided the school system with a photo identification badge solution easily identifying students and staff.  "This system will allow us to know exactly who is entering our schools buildings," said DPS Police Chief Roderick Grimes. "It offers us a high-tech way of keeping track of who is in our buildings, which is useful in cases of emergency."

OH Foster Kids Could Face Sex Offender Registry-type Notification

— A motel known for touting its heart-shaped Jacuzzi for years quietly housed dozens of registered sex offenders and predators.

The Budget Inn on North Federal Highway was one of the few housing options for sex offenders in the city. That is, until the motel's owner learned of the tenants' criminal records this past week and evicted them.

n Friday, 24 offenders were listed on the state's sex offender registry as living at the 50-room motel just south of Oakland Park Boulevard.

Now, most of the offenders who had been staying there are struggling to find a new place to live. They may wind up homeless, highlighting a growing problem in South Florida: Municipal laws have so restricted where offenders can live that many have become homeless or drifters — which makes it harder for law enforcement to keep an eye on them.

"The laws have created this quandary that undermines their very purpose," said Jill Levenson, a clinical social worker studying sex offender issues at Lynn University. "The laws really have to be re-considered."

The motel's owner, Glen Patel, said Monday he was shocked to learn some of his tenants were sex offenders when informed by the Sun Sentinel.

"For the safety of my [other] guests, I can't keep them there," he said.

On a recent night at the motel, several guests said they, too, were alarmed to learn their neighbors were sex offenders. Among the guests staying there last week was a family with two young children.

Patel said state probation officers asked him over the weekend to reconsider evicting the sex offenders because, at least at the motel, the officers knew where they were.

Not to mention, at the motel, the offenders were living in a commercial district, alongside a Best Buy and across the street from a McDonald's — as opposed to being smack in the middle of a residential neighborhood.

State records show at least 36 other offenders have reported staying at the motel since 2007. The offenders' crimes ranged from attempting to solicit a child over the Internet to child pornography, child molestation, kidnapping and sexual battery of a child. Some were repeat offenders.
  

Fort Lauderdale and other cities enacted stringent sex offender residency laws after 9-year-old Jessica Lunsford was raped and murdered in 2005 by a sex offender who lived in her Central Florida neighborhood.

Under state law, people convicted of certain sex crimes involving children can't reside within 1,000 feet of schools, parks, playgrounds, day-care centers and public school bus stops.

Many cities in South Florida extended the zones even farther, up to 2,500 feet. Fort Lauderdale has a 1,400-foot radius.

Fort Lauderdale's ordinance leaves only about 10 percent of the city open for sex offenders, offering few rentals.

When offenders find a rare landlord or motel manager willing to take them, they move in by the drove, forming what authorities term a sex offender "cluster," which is what happened at the Budget Inn.

Probation officers can't order the sex offenders to split up and move, said Thomas Sharrard, a state probation supervisor for Miami-Dade, Broward, Palm Beach and Monroe counties.

"We can only enforce what is in their [court-ordered] conditions, and if there is not a condition that says you cannot live with another sex offender, we can't do anything," Sharrard said. "And if you were to kick them out, then the problem becomes: where do you send them?"

In Palm Beach County, about 50 offenders are registered in the Miracle Park community outside of Pahokee. That location, operated by a ministry, was developed to house offenders.

Greetings, everyone! This is the inaugural SOPHIA newsletter! I have been working on forming SOPHIA for quite some time in cooperation with those most responsible for my  rehabilitation as well as agencies dedicated to the rehabilitation of all sex offenders. I wish to extend my thanks to all my colleagues in the Bullock County correctional Facility in Union Springs, Alabama, as well as those I have worked with since my days as a poster on www.sexcriminals.com, especially Scarlet. Now onto business.

Getting Started

Sophia was the Greek goddess of wisdom, which is fitting since knowledge is the key to rehabilitation. While not the first to teach methods of rehabilitation, SOPHIA is intended for sex offenders who wish to pursue a path of rehabilitation and who also desire a closer relationship with their higher power. Though I am a Catholic, I wish to make SOPHIA accessible to all walks of faith and encourage those of faiths not of my own to share the teachings of their respective faiths as it relates to the issues we all face as sex offenders. By doing so I wish to make SOPHIA unique among all the current programs that currently work with sex offenders. Also, I am calling upon those with artistic talents to design a suitable logo for the organization.

What The Future Holds

I recently read the “Report on Safety Issues Raised by living Arrangements for and location of Sex Offenders in the Community,” a study published in December 2004 by the Colorado Department of Public Safety Sex Offender Management Board. In light of the recent popularity of sex offender residency and proximity/anti-loitering laws, the study made some interesting conclusions:

1. “Shared living arrangements (SLA) appear to be a frequently successful mode of containment and treatment for higher risk offenders and should be considered avaliable living situation for higher risk sex offenders living in the community.” in otherwords, sex offenders do a good job of policing each other, just as it was in my Sex Offenders Anonymous courses and meetings during my incarceration.

2. “Placing restrictions on the location of correctionaly supervised sex offender residences may not deter the sex offender from re-offending and should not be considered as a method to control sexual offending recidivism.” Proximity to schools or other locations have no effect on recidivism rates. Later in the report the researchers noted that it had contacted four states (Alabama, Florida, Illinois, and Oregon) about their residency laws; none of the states passed their laws based on any scientific research.

3. “Efforts should be made to ensure that the sex offender’s support in the home is positive in order to aid in his or her treatment.” The main emphasis in the study is the fact that a support network is crucial to successful sex offender rehabilitation.

The point is while there is not a shortage of organizations and programs dealing with sexual issues, there is currently few formal organization geared towards dealing with the issues which we sex offenders deal with internally AND externally. There are few “SLA” homes as presented in the Colorado study. The grand vision of SOPHIS includes these SLA homes. The main factor in recidivism is instability in life and notably, a lack of support   Network. Thus I see pushing for creation of SLA homes on a grand scale to be integral to our efforts at a new life, or as we said in SOA, “No more victims.” I am presenting this and other research to the mayor of Cincinnati on September 12th. In addition, I am also doing another presentation to a church on September 7th regarding starting a group home. There are about 2 homeless sex offenders in Cincinnati, but I am hoping to change that.

Legal Battles

In the meantime, I am currently fighting the constitutionality of the sex offender residency restrictions. In Iowa, Oklahoma, Georgia, and Massachusetts, there have been temporary injunctions against enforcing these laws. The Iowa case makes the SECOND time a sex offender won a challenge to the laws. My next hearing is Friday the 8th. I am fighting to stay in my current residence. Hopefully soon I will be able to send you some good news. FAMM - 'Sentencing Reform'...its a start!

The U.S. Sentencing Commission will hold its public vote on whether and how to make the lowered crack cocaine sentencing guidelines retroactive on June 30, 2011 at the Commission's headquarters in Washington, D.C.

FAMM members are welcome to attend this historic event. We do not know what time the vote will take place but will get the information out to you as soon as we know.

This is a great opportunity to demonstrate to the Commission that you care and to meet with your congressional representatives and let them know you support sentencing reform. FAMM can help set appointments with your lawmakers and prepare you for your meetings.

How can one leave through this? Everyday sex offenders who are low-risk, non-violent, first- time offenders are shamed with a label and with no hope of living a normal existence. They are judged, chastised and regarded as inhuman scum. Why is it that stray animals are treated with more kindness than someone seeking forgiveness. It is a travesty what America has become with how we view others. First, it was the gays and lesbians that were looked at as disgusting and unholy but now it is the sex offender label that has elevated on that desolate plateau of nothingness. Look around and seek the truth and you will be astounded and ashamed of what you eventually see.

It’s been hotter than heck in Washington, D.C. this week but…FAMM has been, too! 

After a remarkable hearing before the U.S. Sentencing Commission last week, the Washington Post came out today with this fantastic editorial echoing our position on retroactivity for prisoners serving crack cocaine sentences. We’re thrilled they agree that retroactivity should apply to all eligible crack prisoners.

Also today, the Washington Times features an excellent FAMM op-ed highlighting the story of a Florida man sentenced to 20 years for protecting his family with a gun. Read the full story here. The story is important for many reasons but especially because in Florida, we are gearing up for the next legislative session and are determined to show lawmakers in the Sunshine State the human face of their harsh, inflexible sentencing laws.

Our merry band of reformers has also been busy in Massachusetts, where we are preparing for a hearing on our mandatory minimum reform bills. We plan to make sure the legislature’s Judiciary Committee hears why reform is needed NOW! The hearing will take place on July 26th at the State House in Boston.   

Lastly, a little housekeeping: We promised we’d send you the video tape of FAMM member Natasha Darrington’s and my testimony before the U.S. Sentencing Commission. I hope communities call in and complain about sex offenders not having a place to live due to all the restrictions. If they are out in the street or go back to prion what is that accomplishing? If a true, sexually deviate wants to commit a sexual crime, they will. So why are we locking up the non-violent, low-risk, first-time offenders and giving them registry for life?

The National Megan’s Law Helpline (888) ASK-PFML (888) 275-7365, is available to provide support to communities.

It offers information on issues related to accessing sex offender registration information; responsible use of information; sexual abuse prevention resources; and accessing crime victim support services.

Parents for Megan's Law (PFML) staff provide assistance to the community in accessing their state sex offender registries and prevention specialists provide support to parents and community members to assist in their sexual abuse prevention education strategies. Certified rape crisis counselors are available to support all victims of violent crime and to provide geographically appropriate referrals.

The Sex Offender Registration Tips Program provides the public an opportunity to report registrants who are failing to comply with registration requirements, employment or supervision restrictions or who are in positions of trust where they can access children.

Tips can be provided via the Helpline or website at www.parentsformeganslaw.org. This program is not intended to be used to report police emergencies. Dial 911 or contact your local law enforcement agency directly for emergencies. I am opposed to public registries of sex offenders. There is no evidence that registries prevent sex crimes. But it is clear beyond any doubt that thousands of people have been harmed and many lives ruined through the sex offender registries and scarlet letter laws that brand many people that have not committed any crimes against children as "violent, sexual predators" who cannot live, work nor go near a school, public library or other facility where children may be present.

While horrific crimes involving abuse of children do occur, these are rare and comprise a tiny percentage of those convicted with sex offenses. However, the sex offender registries paint ALL offenders with the same brush whether it is teenagers having sex, a person urinating by the side of the road or someone who brutalizes a child. Most sex offenses (more than 80%) are committed by family members or other people well-known to the victim. Repeat offenses by sex offenders are rare with recidivism in most jurisdictions less than 5%. Existing sex offender laws and the elaborate and costly apparatus to enforce these laws have little effect on preventing sex offenses. These laws have sprung up around particularly horrible crimes and are often named after the victims.

Evidence-based approaches to preventing child abuse exist but too often are not applied and too often such programs remain underfunded while large funds are consumed by highly visible approaches that provide political benefits to people seeking to get elected on tough on crime platforms. I propose that all funding for sex offender registries be redirected to fund programs that reduce child abuse. This starts with training children to recognize abuse and abusers and to say no to the abuser and to report abuse to their parents or guardian or other person with responsibility. Abusers whose actions are caught early can be helped to understand their actions and to prevent this behavior in the future. For the sex offender with a deeper problem more intensive therapy would be warranted.

By preventing more cases of child abuse the relatively rare cases involving brutalization of children by violent criminals can be dealt with more effectively through appropriately severe sanctions. In today's environment with thousands of people painted with the same brush as if they are violent, predatory sex criminals the attention of law enforcement is distracted by the large number of offenders increasing the chances for such acts to be committed.

Senior Assistant State’s Attorney Dawn Gallo, who has prosecuted Perlotto’s cases in the past, addressed the issue.

“He (Perlotto) is not the world’s worst enemy. He has let alcohol take advantage of him. He has the chance to be a working member of society. I think today has been a real wake up call for him,” Gallo said. “I don’t know he is the type of person the sex offender registration is designed for.”

On a Personal Note

Thanks for the opportunity to express my thoughts regarding the issue of citizens’ rights, particularly addressing certain sex offenders’ crimes that do not fit the devastating, inequitable and endless punishment given.


As you know, many young men and women lives across the nation are being destroyed by incarceration, life-time registry and restrictive laws that do more harm than good. For those individuals, there is no second chance.

Below is a personal letter to President Obama:

“Dear President Obama,

I truly agree with your sentiments that individuals, such as ex-felons, should be able to receive a second chance at life. Since we all know that one can veer off that path of life and travel along rough, rocky terrain, sometimes running off and ending up in some ditch. We all have made our fill of mistakes and sometimes those held a costly consequence that changed life forever. So we lived through it, trying harder to make things right with family, friends and those around us, but what about those who aren’t able to make things right even if they tried…because they’re labeled as too dirty, a leper, a person who is rejected from society and home.


But what if they’re a seventeen year old and had sex with a fifteen year old, consensual at that? Or they’re a teen that had gotten so enraged after a breakup that he sent out naked pictures of his girlfriend on his cell phone or email? Or an individual urinates where someone just happens to see them?


All are wrong and a travesty but do they deserve the life of no second chance with a registry that ends all. They are labeled, no jobs, no where to live…they have been deemed a menace to society, a plague. These certain circumstances, and many other situations similar to these, I believe still deserve a second change.

Fourteenth Amendment to the United States Constitution


Section 1. All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.


After my son’s early release and two years of prison, I thought I had handled that fact graciously knowing after serving his time he would be able to get that fresh start, that second chance. He was an exemplary inmate, GED, college courses and vocational classes. Little did I know that a second chance on the outside was the farthest from the truth? He now struggles and lives in a trailer park sharing a trailer with another and surrounded by others in the same rocking boat, one to float endlessly in shark infested waters. I see him little because of probation requirements (he couldn’t live with us because we were 800 feet near a school). My family is afraid of what would happen to them if he lived with them…vigilantism. My son has no other place to stay since others condemn him of his crime that is screamed from the highest rooftop. Sex offender, sex offender!

Not all sex offenders are pedophiles or predators but some are simply young kids that make one stupid and rash decision that eventually changes everything, and they have no idea what they’ve done until their life is never their own. Exactly, where is that second chance for those sex-offenders who are lumped together with pedophiles and predators? Now, it makes me sick to think of my son’s future and many like him that are on the registry and many with no second chance…ever. I am asking you as a mother and as another concerned citizen of the United States that these laws are looked at again and taken into serious consideration in what they are doing to the Constitution of the United States, not for sex offenders in general but the future rights of every citizen, before anymore are put into effect. They unjustly strip an offender of their rights and place them in a guillotine that can be easily set off by anyone and at anytime. Where is the second chance for ex-sex offenders in the present, pending and future laws?”

What truly saddens me is the weakness and deterioration of what the sex offense issue is doing to our once, great nation. Across Europe, others are seeing the injustice and disregard of rights, but we ignore this problem and it makes me wonder where humanity is heading….

We have become a hysterical society in which our latest witch-hunt is a sex offender--no matter his/her crime.

“The tragic story of your son's death is just so sad that it's difficult to explain how. It was very hard to read your letters. It seems almost unbelievable that this can take place in a democracy! From our point of view, there is no justice in this. Not in any way: not for you, your son, the former girl friend – or even the state.

It is an abusive legal system. It seems barbaric. And we are so very sorry that this takes place. That's why it's so important for us to try to neutralize the debate with this…, hopefully making some changes. ….. to show the every day life of the sex offenders, trying to show how they keep on being punished, even after served prison time…..But we will for sure tell the story of the injustice that your son has been exposed to.”

I appreciate everyone's commitment and backing to protect everyone's civil rights, plainly as noted in the Constitution of the United States and is presupposed, giving ALL men are “life, liberty and pursuit of happiness.”
