RSOL 2011 National Conference

Hi All Warriors,

Let me introduce myself. My name is Gail, I am the President and Legislative Chair, of the Florida Action Committee, we are the Florida RSOL Affiliate. I believe I have met many of you at the St. Louis conference. I have recruited Rita from NY RSOL and we will begin to coordinate the “March on Washington in 2012”. There is much to do and we have not really gotten too far. What we have identified is we need and want to make this happen. We need a permit and we do not yet have the schedule for the 2012 Legislative session, (so we cannot yet set a date). What we can do is begin the planning. Decide on the actual message of the march and what strategy we will employ to mobilize a HUGE GROUP. I am sending this email as a first point of contact. I was unable to read all of the emails of those who signed up as interested. If you know of anyone else interested please pass this on.

What I need to know from you all is how much are you willing to do to organize for your state.

Once we know who the players are we can schedule a conference call and begin our work. I check email frequently. So let me know what you are willing to do.

I look forward to bringing this to fruition in a “BIG WAY”. Note: Updates will follow!

D.C. Circuit Upholds Sex-Offender Registry

A federal appeals panel in Washington today rejected an argument that the District of Columbia's sex-offender registry is an unconstitutional example of ex post facto punishment.

The challenge to the registry was brought by Grant Anderson, who according to the panel's opinion is required to register as a sex offender for the rest of his life. A jury convicted Anderson in 1988 of attempted rape and other charges. While he was serving his sentence, the D.C. Council in 2000 passed its Sex Offender Registration Act.

Anderson brought the case pro se. U.S. District Judge Richard Roberts granted motions by the District government and the U.S. Justice Department to dismiss the case. On appeal, the U.S. Court of Appeals for the D.C. Circuit appointed a student and professor from the University of Georgia School of Law to argue for Anderson as amicus.

The decision today from a three-judge panel of the D.C. Circuit says the D.C. registry should be viewed as a civil system of regulation and not as an additional criminal penalty. The opinion notes, for example, that the registry is housed in an administrative agency, not in a court office or in an agency charged with carrying out punishment.

"We see no reason to think that the Council's aim with [the registration act] was different from that of the many other legislatures that have passed similar laws," Judge Thomas 
Griffith wrote for the unanimous panel. Judges Merrick Garland and Karen Henderson joined the opinion (PDF).

Griffith wrote that Anderson failed to support his other claims, including violations of the Fifth and Eighth amendments.

Ariel Levinson-Waldman, senior counsel to D.C. Attorney General Irvin Nathan, wrote in an e-mail today: "We are pleased that the court of appeals confirmed the constitutional validity of the Council's regulatory law dealing with this important issue."

A message left with Erica Hashimoto, a University of Georgia associate professor who handled amicus briefing in the case, was not immediately returned today.

Interesting??....now neighbors can report on sex offenders' non-compliance and sent them back to jail? Don't you think that's odd that others have a right to do that. I think harrassment is one way to get SO's out of their area even if there was no non-compliance with them.

And, what about that last line in its entirety... so confusing to say the least, "not use emergency reporting channels". So there isn't much of an emergency threat then, is there?

Fox said he realizes not everyone " believes in what we do,and that's OK but it means you don't have a say. Really Mr. Fox? What if we believe in what your clients do to the downtown area. Do the people who have to put up with being pan-handled have a say? How about the down-town business owners have a say?How about the police department who must increase resources in the area, do they have a say? And since you house sex offenders, do the local parents have a say? I could do this all day Mr. Fox. And whether anybody believes in what you do or not we are a community and this is America so everybody has a say. Especially when your actions effect everyone in said community. I like the idea of moving the shelter to a less populated area. It would benefit the shelter because you could produce food and help instill a work ethic and self respect into there hearts. And the downtown area could be more hospitable to businesses as well as consumers.

29 year old male, falsely accused of rape - Here's his story

Hi! I am a 29 year old male who was falsely accused of rape when I was a minor. When I was 17 yrs old I got accused of raping a 16 year old female. But the thing is I didn't rape her! We have never engaged in any type of sexual activity. I am writing you because I have a family now and I am in desperate need of getting my story heard so that my name can be cleared!
 
Prior to this night, Latoya (name withheld) had been pursuing me for years. On the night that I supposedly raped her she had consensual sex with one of my friends, whom of which was also at my house. I later learned that she snuck out of her house that night, got in trouble with her parents, and ultimately put the blame on me.
 
During court, Latoya let her mother do all of the talking instead of speaking up and telling the truth. I could not afford my lawyer therefore he insisted that I take the plea bargain, otherwise I could have been facing a 15 year sentence in prison.
 
This experience has been very life changing even though it was 12 years ago. I am struggling to provide for my family (my wife and daughter) because I can’t keep a job, and as a result we keep getting evicted from our apartments/houses. At the end of each year, I have at least 15 to 20 W2's for my taxes because I keep getting fired. Continuously getting fired has been very frustrating for me because I have attended college for three years and I still am not able to obtain a job. The most devastating part of it all is that I have to register as a sex offender for the rest of my life!
 
The question that I ask is: What would you do if you were me? Would you be able to handle this punishment for a crime that you didn’t commit?
 
All I want Latoya (name withheld) to do is take a lie detector test so the truth will be known and my name will be cleared! I have made several attempts to accomplish this goal via The Steve Wilko Show, Judge Mathis, Judge Pirro, Tyra Banks but she has declined every offer and repeatedly changes her phone number.
 
I thank you in advance for taking the time out to read this. I also pray that this email has touched your heart and has moved you to help me accomplish my goal. I am more than willing to provide you with in depth details, because I have nothing to hide.

I received this as a personal e-mail from one of my friends at CFC as many of you know they are working on a video documentary now they have all the equipment and the getting started at I will paste part of my friends e-mails to me here if any of you can help with personal stories or possibly videos where you are explaining your situation or your family situation please read through the documentation below and see what you think you can do to help

It is like this my wife is an international prosecuting attorney employed for another country. She carries no weight in America but she is volunteering her time and knowledge of laws and briefings to help us put together a brief and a video that should if all goes well be released hand in hand. Here is a short layout concept we want everything to follow. The idea is simple. we need as many videos and documents from family and friends and children that are being victimized by these laws, we need as many personal stories and videos as possible, we need current law and updated law information, we need money trails, and history trails of the advocates.. This information needs to be broke down into the headings ive posted below. My wife will then break it into as powerful a synopsis as can be. We are going to make a movie out of it and a written documentary. Ounce this is done I have an idea that a few select people can help out with that will hopefully help to get us some positive international recognition.
A. A History of sex offender laws in America
B. wo profits from the sex offender laws in America and their histories
C.Do the sex offender laws work and are they constitutional?
D. Innocent victims of the sex offender laws. Spouses and children.
E. Who is registered under the S/O laws and how does this affect recidivism?
F. (conclusion) Is thier a Better alternative?

I do not know your personal situation but can u get some feelers out for me on some possible videos? My daughter,my wife, and myself have used our little webcam and put some together, the pastor to our church is doing one as well and the more victim stories and stories from our mothers,fathers,sisters,brothers,children,and wives we can collect the bigger a punch we will have.I promise faces will be blotted out very well and basic voice scrambling will be used for privacy and security ounce we receive everything.
I am also working with places like wikileaks and others so we can try to get an international publishing of things if we can get this right.

"California's Little Prison Problem
The current consideration of realignment began this year with Governor Brown's January budget proposal, when he suggested reassigning the incarceration of low-level offenders and the supervision of parolees to the counties. Low level offenders were generally defined as prisoners who had never been convicted of a serious or violent crime, nor been required to register as a sex offender. This proposal was projected to help solve two problems:  the need to cut expenditures, and the requirement to move prisoners in order to ease overcrowding in the state prisons. In addition, those on parole from prison, or on post-release supervision locally, were to be sent back to prison only for the commission of a new crime, and no longer simply for a violation of a condition of their release.

There was serious pushback from local authorities and members' constituents about the lack of capacity in local jails and the lack of local rehabilitation and transition programs.  Visions of wholesale release of dangerous criminals abounded, even though lifers, high risk sex offenders and any felon who had committed a serious or violent crime would remain in the custody of the state prisons. The trick for the budget balancers was how to lower expenditures from the general fund while, at the same time, providing a source of money to fund local governments to incarcerate, rehabilitate and supervise low level offenders, and parolees. Even though the overall cost to the state would be less, money still had to flow to the locals to pay for the public safety piece. And there was more."

Thanks for the opportunity to express my thoughts regarding the issue of citizens’ rights, particularly addressing certain sex offenders’ crimes that do not fit the devastating, inequitable and endless punishment given.


As you know, many young men and women lives across the nation are being destroyed by incarceration, life-time registry and restrictive laws that do more harm than good. For those individuals, there is no second chance.

Below is a personal letter to President Obama:

“Dear President Obama,

I truly agree with your sentiments that individuals, such as ex-felons, should be able to receive a second chance at life. Since we all know that one can veer off that path of life and travel along rough, rocky terrain, sometimes running off and ending up in some ditch. We all have made our fill of mistakes and sometimes those held a costly consequence that changed life forever. So we lived through it, trying harder to make things right with family, friends and those around us, but what about those who aren’t able to make things right even if they tried…because they’re labeled as too dirty, a leper, a person who is rejected from society and home.


But what if they’re a seventeen year old and had sex with a fifteen year old, consensual at that? Or they’re a teen that had gotten so enraged after a breakup that he sent out naked pictures of his girlfriend on his cell phone or email? Or an individual urinates where someone just happens to see them?


All are wrong and a travesty but do they deserve the life of no second chance with a registry that ends all. They are labeled, no jobs, no where to live…they have been deemed a menace to society, a plague. These certain circumstances, and many other situations similar to these, I believe still deserve a second change.

Fourteenth Amendment to the United States Constitution


Section 1. All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.


After my son’s early release and two years of prison, I thought I had handled that fact graciously knowing after serving his time he would be able to get that fresh start, that second chance. He was an exemplary inmate, GED, college courses and vocational classes. Little did I know that a second chance on the outside was the farthest from the truth? He now struggles and lives in a trailer park sharing a trailer with another and surrounded by others in the same rocking boat, one to float endlessly in shark infested waters. I see him little because of probation requirements (he couldn’t live with us because we were 800 feet near a school). My family is afraid of what would happen to them if he lived with them…vigilantism. My son has no other place to stay since others condemn him of his crime that is screamed from the highest rooftop. Sex offender, sex offender!

Not all sex offenders are pedophiles or predators but some are simply young kids that make one stupid and rash decision that eventually changes everything, and they have no idea what they’ve done until their life is never their own. Exactly, where is that second chance for those sex-offenders who are lumped together with pedophiles and predators? Now, it makes me sick to think of my son’s future and many like him that are on the registry and many with no second chance…ever. I am asking you as a mother and as another concerned citizen of the United States that these laws are looked at again and taken into serious consideration in what they are doing to the Constitution of the United States, not for sex offenders in general but the future rights of every citizen, before anymore are put into effect. They unjustly strip an offender of their rights and place them in a guillotine that can be easily set off by anyone and at anytime. Where is the second chance for ex-sex offenders in the present, pending and future laws?”

What truly saddens me is the weakness and deterioration of what the sex offense issue is doing to our once, great nation. Across Europe, others are seeing the injustice and disregard of rights, but we ignore this problem and it makes me wonder where humanity is heading….

We have become a hysterical society in which our latest witch-hunt is a sex offender--no matter his/her crime.

Below is a email sent from a foreign advocate to a father of a sex offender:

“The tragic story of your son's death is just so sad that it's difficult to explain how. It was very hard to read your letters. It seems almost unbelievable that this can take place in a democracy! From our point of view, there is no justice in this. Not in any way: not for you, your son, the former girl friend – or even the state.

It is an abusive legal system. It seems barbaric. And we are so very sorry that this takes place. That's why it's so important for us to try to neutralize the debate with this…, hopefully making some changes. ….. to show the every day life of the sex offenders, trying to show how they keep on being punished, even after served prison time…..But we will for sure tell the story of the injustice that your son has been exposed to.”

I appreciate everyone's commitment and backing to protect everyone's civil rights, plainly as noted in the Constitution of the United States and is presupposed, giving ALL men are “life, liberty and pursuit of happiness.”
