Brief Anonymous Survey on the Effects of Sex Offender Registration Laws -- Please respond by Friday, 7/27/2012 at 12 noon EST
Note:That this survey has been extended and is currently for ALL registrants!
Dear friends and colleagues,
As many of you know I have
been traveling around the country collecting interviews and research on the
impact of sex offender registration laws on child registrants (individuals
under age 18). As I head into the final stages of my research it brings me
great joy to say that you all are tremendous. I am forever bonded to the
families that have selflessly opened up their hearts and welcomed me into their
lives and their homes with open arms. Thank you.
I will start writing and
synthesizing the research in September 2012. The Human Rights Watch report is
scheduled to be published and released in November 2012. I will keep you all
posted on the progress.
In the meantime, I just
learned of a unique opportunity to educate the US Department of Justice on the
harm of sex offender registration laws. I will be meeting with the US
Government Accountability Office (GAO) in Washington, DC on Monday 7/30 @
2:00pm and I would like to take your voices with me. In preparation for this
meeting I would like to collect specific information on how the Federal Sex
Offender Registration and Notification Act (SORNA) and similar laws have
significantly impacted registrants and their families. I would like to hear
your thoughts on the following issues;
- How, if at all, have SORNA-related requirements, or related state laws, affected registrants, who are;
a.
Prosecuted and convicted/adjudicated
delinquent for a sex offense and are required to register?
b.
Subject to non-public notification?
c.
Subject to rather public notification?
d.
Prosecuted and convicted of a registration
violation or “failure to register” offense?
e.
Completed their sentence/juvenile
commitment and are reintegrated back into the community?

Executive Producer Sean Penn proudly
presents "Witch Hunt," a gripping indictment of the United States
justice system told through the lens of one small town. It's John
Stoll's story, but it's also the story of dozens of other men and women
who found themselves ensnared in a spiral of fear, ignorance and
hysteria. These people are Americans, working class moms and dads, who
were rounded up with little or no evidence, charged and convicted of
almost unimaginable crimes. All sexual. All crimes against children.
Years, sometimes decades later, they would find freedom again, but their
lives and the lives of their children would be changed forever. This
film shows viewers what the real crime in this case is, not molestation,
but the crime of coercion. Viewers hear from the child witnesses who
were forced to lie on the witness stand as they describe scary sessions
with sheriff's deputies in which they were told -- not asked -- about
sexual experiences that happened to them. Their coerced testimony led
to dozens of convictions. Many times their own parents were the ones
they put behind bars.
Soon after the trials, the children
started to crack. They told adults of the lies they'd been forced to
tell on the stand and hoped it would make a difference. It didn't and
the convicted continued to sit in prison. As the allegations grew more
outlandish, California's Attorney General wrote a scathing report on the
court misconduct, but instead of being buried by criticism, Kern County
District Attorney Ed Jagels thrived, doing what he did best-- putting
people away. He boasted one of the highest conviction rates in the
country. This strategy served him well. Jagels is still in office
today. Through new interviews, archival footage, and unflinching
narration by Mr. Penn, the filmmakers construct an intimate film that
illustrates a universal point; when power is allowed to exist without
oversight from the press, the community or law enforcement, the rights
of everyday citizens can be lost for decades. National film critic
Marshall Fine says, "This is a chilling story about American
law-enforcement run amok and untethered. It's particularly timely in the
wake of revelations about the way the Bush administration has trampled
American civil rights. A movie that can't help but move you - to tears
and to action."

Folks may remember that on Wednesday the 18th the U.S. House Judiciary Committee Marked Up the Adam Walsh Re-authorization Act (AWRA) (HR 3796) -and- the Edward Byrne Memorial Justice Assistance Grant Program Reauthorization Act of 2012 (HR 6062).
As to AWRA certain amendments were presented which can be found HERE (under HR 3796) but only FOUR of them were approved and will become part of the full AWA (If the Senate also accepts them when they get the bill). The four accepted amendments were presented by Rep. Bobby Scott of Virginia, and are:

- 1) JUVENILE SEX OFFENDER TREATMENT GRANTS REAUTHORIZATION.
- 2) PUBLIC ACCESS TO JUVENILE SEX OFFENDER INFORMATION.
- 3) COMPREHENSIVE EXAMINATION OF SEX OFFENDER ISSUES.
- 4) PROTECTION OF LOCAL GOVERNMENTS FROM STATE NONCOMPLIANCE PENALTY UNDER SORNA.
As best I interpret the four here is what each does:
1) Reduces
the Grant money for "Juvenile sex offender treatment programs"
(42 USC 3797-EE-1)
from $10,000,000 to $2,979,000 for each fiscal year 2013 through 2017. I'd say
that is NOT GOOD, but have no idea why a reduction is warranted.
2) Adds this new section making it MANDATORY to EXEMPT from the Public Registry "any information about a sex offender for whom the offense giving rise to the duty to register was an offense for which the offender was adjudicated delinquent (or otherwise convicted) as a juvenile." That sounds GOOD, apparently some states were still showing these juvenile sex offenders publicly.
3) Under section 634 "COMPREHENSIVE EXAMINATION OF SEX OFFENDER ISSUES" Congress wants to add a new report, in addition to the reports already listed. The NEW report "Not later than one year after the date of enactment of the Adam Walsh Reauthorization Act of 2011 (AWRA), the National Institute of Justice shall submit to Congress a report on the public safety impact, recidivism, and collateral consequences of long-term registration of juvenile sex offenders, based on the information collected for the study under subsection (a) and any other information the National Institute of Justice determines necessary for such report."

Folks may remember I did address
Section 634 in my Commentary "PART-III:
Behind Closed Doors: The Adam Walsh Act Way, now the States are following?.
This new report covering juveniles SOUNDS GOOD, but I do have a concern about
interpreting "public safety impact." Will that be construed to INCLUDE
"effects on the registrant and family, if any" and if not it should.
Now because I see some other differences in the reporting between juveniles and
adults, and not wanting to muddy the waters here, I will do a separate
Commentary addressing those differences within a few days.

4) This
one is odd, best explained by looking at this from the point when the state
gets Byrne Grant Money. When states get funding through the Byrne Grant there
is a statute (42 USC
3755) which tells them how to disburse the money to their local
governments, and what portion the state keeps.
So this amendment is saying, if a state chooses NOT to come into compliance with SORNA, that the state "shall return to the Attorney General (for reallocation in accordance with subsection (c))" its Byrne Grant portion less what was already given to local governments. In essence Congress does not want to penalize local governments since local governments have no say in whether the state complies w/SORNA or not.
So this amendment is saying, if a state chooses NOT to come into compliance with SORNA, that the state "shall return to the Attorney General (for reallocation in accordance with subsection (c))" its Byrne Grant portion less what was already given to local governments. In essence Congress does not want to penalize local governments since local governments have no say in whether the state complies w/SORNA or not.
This is my best understanding of
these amendments (links to the four are above). Any other interpretations are
welcomed, please comment so other folks can see your comments.

AWA Reauthorization Act (HR 3796)
You probably have already gotten the news, but the AWA Reauthorization
Act (HR 3796) was marked up today. Subcommittee on Crime Ranking Member
Scott offered ten amendments; only four were accepted. The bill was
reported favorably out of Committee.
Call your Senate and House representatives and ask them to NOT support this. Also, here is the committee talked about above:
